Government initiates administrative review of anti-dumping duty on cold-rolled coils from Vietnam

The government will initiate an administrative review in accordance with the Countervailing and Anti-Dumping Duties Act 1993 and the Countervailing and Anti-Dumping Duties Regulations 1994, with the final determination of the administrative review to be made within 180 days of the date of the initiation.
The International Trade and Industry Ministry (MITI) said the move comes after the government initiated an anti-dumping investigation upon receiving a petition from a domestic producer, Mycron Steel CRC Sdn Bhd, requesting for an administrative review of anti-dumping duties imposed on imports of cold-rolled coils of alloy and non-alloy steel (subject merchandise) originating or exported from Vietnam.
It said the government has evaluated and considered the prima facie evidence that the dumping margin of the subject merchandise from Vietnam had substantially changed, and decided to initiate an administrative review on anti-dumping duties imposed on imports of the subject merchandise from Vietnam.
“The request is made in accordance with section 28(1)(a) of the Countervailing and Anti-dumping Duties Act 1993, which is based on the grounds that dumping margins for the alleged country have substantially changed from the previous administrative review that was concluded on May 8, 2019.
“The original anti-dumping investigation was initiated on Aug 27, 2015 and affirmative anti-dumping duties were imposed on imports of cold-rolled coils of alloy and non-alloy steel from the People’s Republic of China, the Republic of Korea and Vietnam from May 24, 2016 until May 23, 2020,” it said in a statement.
On Nov 9, 2018, the Malaysian government had initiated the first administrative review of anti-dumping duties imposed on the same subject merchandise originating or exported from the same alleged countries.
The government however decided to review and imposed affirmative anti-dumping duties from May 8, 2019 until May 23, 2020, ranging from Nil duty to 42.08 per cent on imports of cold-rolled coils of alloy and non-alloy steel originating or exported from China, the Republic of Korea and Vietnam.
In connection with this investigation, MITI said it will provide a set of questionnaires to interested parties, such as importers, foreign producers, exporters and associations.
Other interested parties may request for the questionnaires in writing to MITI no later than Aug 12, 2020, it said, adding interested parties may also provide additional supporting evidence to the ministry by Aug 27, 2020.
“In the event no response is received within the specified period, the government will make its preliminary findings based on the best facts available,” it said.
